Terms of service

1. Who we are

SmartPips ("SmartPips", "we", "us") is a market-analysis and trading-education service operated from Baku, Azerbaijan. You can reach us at support@smartpips.pro or +994 99 799 00 99, or write to us at Baku, Azerbaijan.

In these terms, "the service" means the website, the signal feed, the results archive, the copy-trading connection, the e-shop, and any related communication we send you.

2. What SmartPips is — and what it is not

We publish our own market analysis and the trade setups our desk takes. That is the whole product.

We are not a broker, a dealer, an exchange, a fund, or a portfolio manager. We never hold, receive, or move your money. We are not licensed as an investment adviser in any jurisdiction, and nothing we publish is personal investment advice, a personal recommendation, or an offer to buy or sell any instrument.

Every decision you make with our material is your own decision, taken on your own account and at your own risk.

3. Who may use the service

To open an account you confirm that:

• you are at least 18 years old and have full legal capacity to enter into this agreement;
• you are not resident in, or accessing the service from, a country where receiving it would be unlawful;
• you are not subject to any sanctions list that would prohibit us from dealing with you;
• you are acting for yourself and not on behalf of an undisclosed third party.

4. Your account

Registration asks for your first name, last name, country, Telegram username and email address. Give us accurate details and keep them current — we use them to deliver signals and to verify who you are.

We confirm your email with a six-digit code before the full signal feed is opened to you. One account per person; accounts may not be shared, sold, lent or transferred.

You are responsible for keeping your password confidential and for everything done under your account. Tell us immediately at support@smartpips.pro if you believe someone else has gained access.

5. Signals, analysis and permitted use

Your subscription is a personal, non-exclusive, non-transferable, revocable licence to view and act on our material for your own trading.

• You may not republish, resell, broadcast, forward or mirror our signals — in whole or in part — to anyone else, whether free or for payment.
• You may not operate a group, channel, feed or service that redistributes our content.
• You may not scrape, crawl, or use automated means to extract the feed, nor circumvent the registration gate.
• You may not remove or obscure any notice of ownership from our material.

We monitor for redistribution. Where we find it, we close the account without refund and reserve every other remedy available to us.

6. Plans, billing and cancellation

Free access shows a limited number of the most recent signals. Paid plans are billed in advance for the period shown at checkout, and renew automatically for the same period unless you cancel first.

You can cancel at any time from your account. Cancelling stops the next renewal; your access continues to the end of the period you have already paid for. There is no minimum term and no exit fee.

Prices are shown in US dollars unless stated otherwise and exclude any tax or bank charge that applies where you live. Refunds are governed by our Refund Policy.

7. Copy trading

Copy trading connects your own broker account to our desk through your broker's own investor facility. Your funds stay with your broker at all times — we never take custody and we cannot withdraw from your account.

You set the risk ceiling, and you can disconnect the link at any moment without asking us. Between the moment you disconnect and the moment your broker applies it, positions already open may still move.

Execution price, spread, swap, commission and slippage are set by your broker, not by us, so your results will differ from the desk's published results.

8. Digital products in the e-shop

Indicators, expert advisors and e-books are licensed to one person for use on the number of accounts stated on the product page. The licence is personal and may not be resold, shared, decompiled, or redistributed.

Software is provided as it is. An expert advisor automates a strategy; it does not guarantee a result, and you remain responsible for supervising anything trading on your account.

9. Intellectual property

The site, its design, text, charts, illustrations, code, the SmartPips name and logo, and the signal archive are owned by SmartPips or licensed to it, and are protected by copyright and trade-mark law. Nothing in these terms transfers any of that to you.

10. Availability, changes and third parties

We work to keep the service available, but we do not promise uninterrupted access. Maintenance, hosting incidents, network faults and events beyond our control can interrupt it.

We may add, change or withdraw features. If we make a change that materially reduces what a paid plan provides, we will tell you in advance and you may cancel.

The service depends on third parties — your broker, Telegram, our email and payment providers. Their terms apply to their part, and we are not responsible for their acts or failures.

11. Conduct we do not allow

• attacking, probing or overloading the service, or trying to gain access you were not granted;
• uploading malware, or using the service to distribute unlawful, abusive or misleading material;
• impersonating another person, or using false registration details;
• using the service to launder money, evade sanctions, or commit any offence.

12. Suspension and termination

We may suspend or close an account that breaches these terms, that we are legally required to close, or that is being used in a way that endangers other members. Where the breach is ours to prove and the account was paid, we will refund the unused part of the period unless the breach was redistribution or fraud.

You may close your account at any time by writing to support@smartpips.pro.

13. Disclaimers

The service is provided "as is" and "as available". To the fullest extent the law allows, we exclude all implied warranties, including fitness for a particular purpose and any warranty of accuracy, completeness or profitability.

We do not warrant that any signal will be profitable, that our analysis is correct, or that the published record predicts anything about the future. Please read the Risk Disclosure — it is part of this agreement.

14. Limitation of liability

To the fullest extent permitted by law, SmartPips is not liable for trading losses, lost profits, lost opportunity, loss of data, or any indirect or consequential loss arising from your use of the service.

Where liability cannot lawfully be excluded, our total liability to you for all claims in any twelve-month period is limited to the amount you paid us for the service in that period.

Nothing here limits liability for fraud, or for anything that cannot be limited under the law that applies to you.

15. Indemnity

You agree to hold SmartPips harmless from any claim, loss or cost arising out of your breach of these terms, your misuse of the service, or your redistribution of our material.

16. Changes to these terms

We may update these terms. The date at the top of this page shows the current version. If a change materially affects your rights we will notify you by email or on the site before it takes effect. Continuing to use the service after that date means you accept the new version.

17. Governing law and disputes

These terms are governed by the law of the Republic of Azerbaijan, and the courts of Baku have jurisdiction — except where the mandatory consumer law of your country of residence gives you the right to bring proceedings locally.

Please write to support@smartpips.pro first. Most disputes are settled far more quickly that way than through a court.
